  1. General
    This Website www.tingkatdelivery.com (the “Site”) is operated by RichFood Group Pte Ltd (the “Company”), and the products and services available through this Website (collectively, the “Services”) are made available to you in accordance with the following terms and conditions. You agree to be legally bound by our Terms of Use (“TOU”) and our Privacy Policy by using this Site and its services. You may not use this site if you do not agree to be bound by this TOU. We reserve the right to update or revise the TOU at our sole discretion.
  1. Use of the site
    You must not misuse this Site, including but not limited to, committing a criminal offense; distributing a virus, malware, trojan, worm, logic bomb or any other material on the Site, or its related social media and/or communication platforms, which is malicious or in any way offensive or obscene; adding to, removing, augmenting, changing, defacing, hacking, corrupting data of contents on the Site; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material; or accessing or using the Site in any way that could or is intended to cause damage or impair the Site, or any server or network underlying the Site; causing annoyance to or interfere with the use and enjoyment of the Site by other users. Breaching this provision would constitute a criminal offence under the Computer Misuse and Cybersecurity Act 2013. The Company will report any of such breach to the relevant law enforcement authorities and appropriate legal action will be undertaken. The Company will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, malware, spyware or any other technologically harmful material that may infect your technological device(s) used to access the Site and/or Linked Sites, computer equipment, computer programs, data, or other proprietary material due to your use of the Site and/or Linked Sites, or to your downloading of any material posted on Site and/or Linked Sites.

Purchase

  1. Eligibility to purchase
    You are eligible to use the services only if you agree to and abide by the TOU at all times. To place an order you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us at the point of purchase. The Services are not available to minors under the age of 18 or to any users suspended or removed by us for any reason.By confirming a purchase, you have authorised us to process a charge or charges on your Credit or Debit account in the amount of the total purchase price for the Services purchased.Services purchased by you are for personal or gift use and should not be used for commercial purposes, or to derive any commercial benefit. The Company also reserves the right to restrict multiple quantities of an item being purchased and/or shipped to any one customer or postal address.With the use of our Services, you have agreed that we may use personal details provided by you to conduct appropriate anti-fraud checks and controls as and when required. Under such circumstances, the personal details you have provided may be disclosed to a credit reference or fraud prevention agency acceptably to us, which may keep a record of the information.

We reserve the right to revoke any stated offer, correct any errors, inaccuracies or omission and make changes to prices, content, promotion offers, product descriptions or specifications, or other information without any obligation to inform you of such changes. We also reserve the right to limit quantities and to revise, suspend or terminate an event, promotion at any time without notice. The inclusion of any products or services on this Site at a particular time does not guarantee its availability. We also reserve the right to adjust and/or restrict the amount of information that you are entitled to view on the Site.
  1. Orders
    All orders are subject to acceptance and availability, and items in your shopping cart are not reserved by you or for you and may be purchased by other customers.
  1. Pricing Policy
    Prices shown on the Site are in SGD and are inclusive of all prevailing government taxes applicable in Singapore. If you are a customer whose credit or debit card is not denominated in SGD, the final price will be calculated in based on your card insurer’s policy. Delivery costs may be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’ or ‘Total Price’.
  2. Payment
    Payment can be made via Bank Transfer/PayNow or Paypal Secure Payment Gateway, or and any other methods which may be advertised on the Site. In order to make purchases, you will be required to provide your personal details such as your name, phone number, e-mail address and other requested information as indicated that you represent and warrant are both valid and correct. Furthermore, you will also be required to provide payment details that you also represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided or an authorisation by the owner of the credit or debit card to use it. By placing an order, you undertake that there are sufficient funds or credit facilities to cover the cost of the goods. All credit or debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to the Company, we are not liable for any delay or non-delivery of your orders. The Company will not be liable for any credit card fraud. The liability for any fraudulent use of a credit card will be on the user and the onus to prove otherwise shall also be exclusively on the user.

Delivery

  1. Delivery
    We deliver to most areas in Singapore except Central Business Districts and certain areas of Central Singapore. All items will only be delivered to one (1) local Singapore residential address as stated by you. Postal box address is not acceptable. We engage third party courier company for the delivery service. We deliver only on weekdays (Monday to Friday), excluding weekends and public holidays, eve and first three days of Chinese Lunar New Year (4 Days).We reserve the right to refuse delivery if any amount owing to us is not paid in full or if there are any other reasons preventing us from carrying out the delivery. The risk of loss lies with you during the delivery of the items.

Refund

    Should you decide to terminate your meal package after full payment has been made, there will be no refund. No reinstatement is allowed once cancellation is done.

Indemnity & Others

  1. Indemnity
    You agree to indemnify, defend and hold the Company, its parent company, directors, officers, employees, administrators, agents, and all other affiliates harmless, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website and its Services including in violation or breach of the TOU or your violation of any applicable law, rule or regulation.
  2. Limit on liability
    This Site and the Services provided hereunder, the information on this Site and use of all related facilities are provided on an “as is, as available” basis without any warranties, either expressed or implied, including but not limited to warranties in relation to any inaccuracies or omissions on this Site, warranties of title or implied warranties of merchantability or fitness for a particular purpose. The Company does not warrant that the Site will always be accessible, uninterrupted, timely, secure, error free or free from computer virus or other invasive or damaging code or that the Site will not be affected by any force majeure events. No oral advice or written information or information delivered in any other form given by the Company or its affiliates, or any of its administrators, officers, directors, employees, agents, providers, merchants, sponsors, licensors, or the like, shall create any warranty whatsoever.These Terms and Conditions and all contractual and non-contractual obligations arising out of or connected to them shall be governed and construed in accordance with Singaporean Law. Should there be any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Singaporean courts. All dealings, correspondence, contacts and communications between the Company and yourself shall be made or conducted in the English language.

    Under no circumstances shall the company, its affiliates, nor any other party involved in creating, producing, manufacturing, distributing, marketing, or selling the service products, services or this Site, be liable for any direct, indirect, incidental, special, punitive or consequential damages, including without limitation, lost profits resulting from the use of or inability to use the Services, including but not limited to reliance by you on any information obtained from the service or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, worms, trojan, delays in operation or transmission, or any failure of performance, which might be the resulting of force majeure, communications failure, theft, destruction, or unauthorized access to the Company’s records, programs, data or services.

    The Company shall not be liable for any failure to perform any of our obligations under these TOU if such failure is the result of circumstances beyond our control including without limitation any natural disaster and unavoidable incident, actions of third parties or any other force majeure regardless of whether the circumstances in question could have been foreseen. We also do not assume any liability for harassing, offensive, defamatory or obscene material distributed through the accounts of this Site, nor do we assume liability for information which may be in violation of the intellectual property or other rights of third parties.

    We will not be liable for any loss or damage associated with a distributed denial-of-service attack, viruses, trojan, worm or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Site or to your downloading of materials posted on it, or to third party websites linked to it.

    The above exclusions and limitations apply only to the extent permitted by law. Your statutory rights as a consumer under the Singaporean law that cannot be excluded or limited are not affected.

    If any clause in these TOU shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall in no way affect any other clause or part of any clause in this TOU, all of which shall remain in full force and effect, so long as these TOU shall be capable of continuing in effect without the unenforceable term. Only the affected term, condition or provision can be modified by the Court to effect the original intent of the parties as similarly as possible such that the contemplated transactions are fulfilled and the Company and its affiliates are protected to the greatest extent possible

  3. Intellectual Property Rights
    All contents included on this Site, such as text, graphics, photographs, logos, audio or video clips, digital downloads, data compilations, and software, is the property of the Company and/or its content suppliers and are protected by Singapore and international copyright laws and treaties. You may store, print and display the content supplied solely for your own personal use and that you must maintain any notices contained in the content, such as all copyright notices, trademark legends, or other proprietary rights notices. None of the contents may be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted or circulated whether in whole or in part, unless expressly permitted by us and/or our suppliers, as the case may be. Misuse of any trademarks or any other contents displayed on the Site is prohibited. All rights not expressly granted herein are reserved. Other product and company names mentioned herein may also be the trademarks of their respective owners.
  4. Termination of Services
    Access to this Website is permitted only on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We shall not be liable for any damages, losses, cost or expenses associated with the termination of any part of the services, to you or any other individual. This termination may also apply to the termination of the sale of all products on the Site, regardless of whether payment has been made (for such a case, payment shall be refunded to the customer or the issue resolved on a case-by-case basis). The cancelling, blocking or denying of a sale or purchase can be effectuated in the event of suspected breach of TOU, fraud, hacking or technical or server complications.
  5. Amendments to the Terms of Use
    We reserve the right to change the TOU at any time. If we make any change to the TOU, we will post those changes on this, or any other appropriate page, and they will become effective upon the later of 1) the date specified by the Company, if any, or 2) the date of the posting. Continued use of the Site will be deemed to constitute acceptance of the new Terms and Conditions.
